PREAMBLE
Let it be known that Artbridge Nexus is not a marketplace, nor a gallery, nor a broker of art. It is a framework of intelligence and verification, established to bring clarity to the art market and to connect those who make with those who steward.
These Laws govern all who enter our domain—whether as artist, collector, institution, or inquirer. By using our website, our services, or our resources, you agree to be bound by them. If you do not agree, you may not use our services.
ARTICLE I: ON THE NATURE OF OUR SERVICES
1.1 Artbridge Nexus provides independent research, market intelligence, due diligence, and selective introductions. We do not sell art, nor do we take commissions on sales.
1.2 We are not a gallery, not an agent, and not a fiduciary. No relationship of agency, partnership, or joint venture is created through the use of our services.
1.3 Any relationship formed between an artist and a collector through our introductions is a direct relationship between those parties. Artbridge Nexus is not a party to any agreement, sale, or transaction that may result.
1.4 The Nexus Credential is a verification of professional standing based on our independent research. It is not a guarantee of future success, sales, or institutional recognition. Market outcomes depend on countless variables beyond our control.
ARTICLE II: ON THE FELLOWSHIP
2.1 The Visual Artist Fellowship is by invitation only. Submission of a portfolio does not guarantee an invitation, nor does it create any right or expectation thereof.
2.2 Admission to the fellowship is determined by the Council after a comprehensive evaluation process, as documented in our Vetting Process and Methodology.
2.3 The Council reserves the right to revoke the Nexus Credential and terminate fellowship status if an artist violates these Laws or engages in conduct that brings the fellowship into disrepute.
2.4 The fellowship is a relationship of mutual respect, not a contract for services. Nothing herein guarantees continued access to any specific service or benefit beyond what is agreed upon in writing at the time of invitation.
ARTICLE III: ON PAID SERVICES
3.1 Artbridge Nexus offers paid services to three distinct audiences: Artists, Collectors, and Institutions. Each service is tailored to the needs of its audience and governed by the terms below.
3.2 Payment terms, fees, and scope of work shall be provided upon inquiry and agreed upon in writing before services commence.
3.3 All reports, briefs, and advisory services are custom research. As such, they are non‑refundable once delivered.
3.4 Recipients of paid services agree to keep the contents confidential. You may not copy, reproduce, distribute, or resell any portion of a paid report or advisory materials to any third party without express written consent from the Council.
3.5 Information provided in our services—including but not limited to market analysis, due diligence, and collector intelligence—is for informational purposes only and shall not be construed as financial, legal, or investment advice.
3.6 Services for Artists
3.6.1 Market Briefs: Monthly and quarterly intelligence on market trends, institutional shifts, and collector behavior, tailored to the artist's practice and location.
3.6.2 Collector Reports: Deep dossiers on specific collectors, including acquisition history, taste, stewardship preferences, and approach strategies. Each report is 5–7 pages of verified intelligence.
3.6.3 Local Event Intelligence: Geo‑specific briefs for major art hubs, identifying key contacts (curators, collectors, advisors) and providing guidance on preparation and approach.
3.7 Services for Collectors
3.7.1 Due Diligence & Verification: Deep research on specific artists, including provenance, exhibition history, market coherence, and institutional recognition. Delivered as a confidential written report.
3.7.2 Curated Artist Shortlists: Quarterly or bespoke lists of emerging and mid‑career artists aligned with the collector's taste, with context on institutional trajectory and market signals.
3.7.3 Introduction Facilitation: Warm, verified introductions to artists and galleries aligned with the collector's vision. Always discreet, always with consent. The collector owns the relationship from the first conversation.
3.8 Services for Institutions
3.8.1 Due Diligence for Acquisitions: Comprehensive verification of artist standing, exhibition history, and market context, enabling institutions to acquire with confidence.
3.8.2 Curated Artist Shortlists: Tailored recommendations for exhibitions, programming, or collections, built on deep knowledge of emerging and established voices.
3.8.3 Exclusive Access to Fellowship Artists: Privileged introductions to Artbridge Nexus Fellows for acquisitions, commissions, or institutional partnerships.
3.8.4 Ongoing Intelligence Retainer: Continuous scanning, vetting, and reporting on emerging and underrecognized artists aligned with the institution's vision.
3.9 The Council reserves the right to refuse service to any individual or entity, for any reason, at its sole discretion.
3.10 Paid services are subject to availability. Capacity is limited, and inquiries are reviewed in order of receipt.
ARTICLE IV: ON FREE RESOURCES
4.1 The Nexus Handbook, Public Briefs, The Desk, and Artist Tributes are offered freely to the artistic community as an investment in the broader public good.
4.2 You are granted a non-exclusive, non-transferable license to use these resources for your personal and professional development.
4.3 You may not upload these resources to public file-sharing sites, include them in commercial products, or distribute them in any manner that suggests they are your own work.
4.4 The Council may update or discontinue any free resource at its discretion, without notice.
ARTICLE V: ON ACCOUNTS AND PORTAL ACCESS
5.1 Access to certain areas of our website, including any future client portal, may require registration. You agree to provide accurate and complete information and to keep your login credentials confidential.
5.2 You are responsible for all activity that occurs under your account.
5.3 You may not use the portal to harass others, upload malicious content, or attempt to gain unauthorized access to any part of our systems.
5.4 The Council reserves the right to suspend or terminate any account for violation of these Laws.
ARTICLE VI: ON INTELLECTUAL PROPERTY
6.1 All content on this website—including the Eight Laws, our methodology, written articles, the Nexus Credential mark, and the gold diamond icon—is the sole property of Artbridge Nexus.
6.2 The name "Artbridge Nexus" and all associated logos are trademarks. You may not use them without prior written permission.
6.3 You retain full ownership of your own portfolio and artistic work. Nothing in these Laws grants us any rights to your art.
ARTICLE VII: ON DISCLAIMERS AND LIMITATION OF LIABILITY
7.1 Our services are provided "as is" and "as available." We make no warranties, express or implied, regarding the accuracy, completeness, or reliability of any information provided.
7.2 We do not warrant that our services will be uninterrupted, error-free, or free of harmful components.
7.3 To the fullest extent permitted by law, Artbridge Nexus shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your use of our services or any transaction between you and another party.
7.4 Because we are not a party to any transaction between artists and collectors, you agree to release us from any claims or damages arising from such transactions. Your sole remedy for any dispute with another user is to seek resolution directly with that party.
ARTICLE VIII: ON INDEMNIFICATION
8.1 You agree to indemnify and hold Artbridge Nexus, its Council members, and its advisors harmless from any claims, damages, or losses arising out of your breach of these Laws or your violation of any law or the rights of any third party.
ARTICLE IX: ON PRIVACY
9.1 Your use of our website and services is also governed by our Privacy Policy, which is incorporated into these Laws by reference.
9.2 The Privacy Policy explains how we collect, use, and protect your information.
ARTICLE X: ON GOVERNING LAW AND DISPUTES
10.1 These Laws shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of laws principles.
10.2 Any dispute arising out of or relating to these Laws shall be resolved through binding arbitration in accordance with the UNCITRAL Arbitration Rules. The arbitration shall be confidential and shall take place in a mutually agreed upon location, or if no agreement can be reached, via virtual proceedings.
10.3 You agree that any claim or cause of action arising out of these Laws must be filed within one year after such claim or cause of action arose, or it shall be forever barred.
ARTICLE XI: ON CHANGES TO THESE LAWS
11.1 The Council reserves the right to amend these Laws at any time. Changes will be posted on this page, and your continued use of our services constitutes acceptance of the revised Laws.
11.2 It is your responsibility to review these Laws periodically.
ARTICLE XII: ON SEVERABILITY
12.1 If any provision of these Laws is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
